Terms of Use

1. Purpose and Scope

These Terms of Use (“Terms”) govern the access and use of the Offmy software, operated by Offmy LLC (“the Company”).

Offmy is a SaaS (Software as a Service) platform designed for agencies and content creators — particularly those active on MYM — to manage their operations, teams, communications, and performance analytics efficiently.

By using Offmy, the User agrees to comply with these Terms in full.

2. Access to the Service

Offmy is accessible via desktop applications available for Windows and macOS.
A stable internet connection and user account are required to access the platform.

The Company may temporarily suspend access for maintenance, updates, or security reasons.
No compensation shall be claimed in the event of temporary service interruptions.

3. Main Features

Offmy provides several key features to help agencies and creators optimize performance and save time, including:

  • Pro Messaging (multi-window): manage multiple conversations with fans simultaneously, categorize fans, add internal notes, and assign chatters to specific creators.
  • Creator Management: add, edit, or remove connected MYM creator accounts, enable auto-renewal, and control employee access.
  • Employee Management: create employee profiles (Chatters or Admins), define roles, and approve access requests for creators.
  • Scripts & Message Tools: create and send pre-written or automated messages to improve engagement and sales efficiency.
  • Clock-in System: track employee working hours and sales performance during shifts.
  • Shift Scheduling: plan and assign time slots for employees and monitor their progress.
  • Sales & Performance Analytics: analyze creator and employee results, revenue, fan data, and conversion trends.
  • Dynamic Pricing & Subscriptions: transparent pricing based on creator revenue tiers, with prorated billing and free trial periods.

The Company reserves the right to modify, update, or remove certain features at any time to improve the service.

4. Account Creation and Management

To access Offmy, Users must create an account by providing accurate and up-to-date information (name, email, role, password, etc.).

Users are solely responsible for maintaining the confidentiality of their login credentials and all activities performed through their accounts.
In case of loss, theft, or unauthorized access, the User must notify the Company immediately.

The Company reserves the right to suspend or terminate any account found to be fraudulent, incomplete, or in violation of these Terms.

5. User Responsibilities

Users agree to:

  • Use Offmy exclusively for lawful and professional purposes;
  • Keep all data accessed through the platform (creators, employees, fans, etc.) confidential;
  • Not share or resell their account access to unauthorized third parties;
  • Refrain from reverse-engineering, attempting to breach, or interfering with Offmy’s systems.

Users are fully responsible for all content uploaded, shared, or created within Offmy, including scripts, messages, and media shared with fans.

6. Subscription, Billing, and Termination

Offmy operates on a monthly subscription model with tier-based pricing depending on the revenue generated by connected creators.

  • Payments are processed through secure third-party providers (e.g., Stripe).
  • Billing is calculated on a prorated basis according to usage and creator earnings.
  • A free trial period may be offered under the conditions displayed on the website.

Users may cancel their subscription at any time through their account dashboard.
No refunds will be issued for partially used billing periods.

The Company reserves the right to suspend or terminate any account in case of non-payment, fraud, or violation of these Terms.

7. Intellectual Property

All components of Offmy (source code, interface, design, graphics, text, logos, documentation, databases, etc.) are the exclusive property of the Company.

Any reproduction, modification, or redistribution of these elements without prior written authorization is strictly prohibited.

Users retain ownership of their imported data (creator accounts, sales, analytics, etc.), provided it complies with applicable laws and these Terms.

8. Data Privacy and Security

The Company is committed to complying with the General Data Protection Regulation (GDPR) and applicable privacy laws.

Collected data is used solely for the operation of the service and is never sold to third parties.

Data is stored on secure servers located within the European Union or in countries recognized as providing adequate data protection by the European Commission.

9. Limitation of Liability

The Company shall not be held liable for:

  • Damages resulting from misuse or non-compliance with these Terms;
  • Temporary interruptions due to maintenance, technical issues, or external services (e.g., MYM);
  • Loss or corruption of data caused by user negligence or unauthorized access.

In any case, the Company’s total liability shall not exceed the total amount paid by the User within the last three (3) months of service.

10. Modifications to the Service and Terms

The Company reserves the right to modify these Terms and the features, pricing, or access conditions of the service at any time.

Users will be notified of major updates by email or in-app notification.
Continued use of the service after such modifications constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by French law.
Any dispute arising from the use of the service shall fall under the exclusive jurisdiction of the Courts of Toulouse, France, unless otherwise required by law.
